In Kentucky, there is a one year statute of limitations for personal injury cases (except cases covered by the No-Fault Act). That is, your claim must be settled, or your lawsuit must be filed within one year of the negligent act, or your right to recover will be lost. Claims arising from a car crash, motorcycle accident or truck wreck are covered by Kentucky No-Fault Act, and the statute of limitations is 2 years from the date of accident, or 2 years from the last PIP benefit paid (not to exceed 4 years).
Wrongful death cases must be filed within 2 years of the date of death, but no later than one year from the appointment of the executor or administrator in probate court. Unfortunately, Kentucky law does not allow recovery for “loss of enjoyment of life.” Damages in a wrongful death case are limited to the lost earning power of the decedent, funeral bills, plus personal injury damages incurred prior to death (pain and suffering, medical expenses, etc).
