Legal Malpractice claim reinstated
July 14, 2010-- Tonia Freeman hired a Louisville personal injury law firm to handle her case. The law firm failed to file suit within the one year statute of limitation. After the insurance company denied Freeman's claim based on the expired deadline, the lawyers declined the case stating that they were no longer interested in representing her.
After Freeman consulted with new counsel, she discovered that her initial lawyers permitted the statute of limitations to expire on her claim. She sued them for legal malpractice. The trial court dismissed her legal malpractice case on summary judgment. The Kentucky Court of Appeals reinstated the case, holding that Freeman case should be decided by a jury.
