If you have been injured in an auto accident or truck accident in Kentucky, you are entitled to Personal Injury Protection Benefits (PIP) also known as No-fault Benefits, regardless of who is at fault.

If the crash is someone else’s fault, you may be entitled to make a personal injury claim against that driver. And if that driver is uninsured or underinsured, you might be able to make a claim for UM or UIM benefits under your own auto policy, or a policy of a relative with whom you reside.

PIP Benefits, also called No-Fault Benefits, are provided by the automobile insurance company covering the vehicle you were occupying when the wreck occurred. (If you were a pedestrian, PIP Benefits are provided by the car that hit you).

Under Kentucky law, PIP covers all hospital bills, medical expenses and chiropractic expenses up to a maximum of $10,000.00. Once PIP coverage is “exhausted” (the maximum amount is paid out), medical expenses should be submitted to your health insurance. If you don’t have health insurance, the excess medical bills will be included in your personal injury claim against the at-fault driver’s insurer.

PIP also covers your lost wages up to $200 per week, provided that you have an off work statement from your doctor. Your PIP lost wages, and any other PIP benefits paid (such as replacement services and milage to doctor visits), count against the maximum of $10,000. Your excess lost wages will be included in your personal injury claim against the at-fault driver.

PIP coverage is mandatory on all automobile insurance policies in Kentucky, unless rejected. However, PIP coverage is optional on motorcycle insurance policies. Some insurance companies sell “pedestrian only” PIP coverage on motorcycle policies, which provide no coverage to the motorcyclist.
