Long Term Care Insurance
If you or a loved one have been wrongfully denied Long Term Care (LTC) benefits, you may have legal recourse against the insurance company. The details of Long Term Care insurance policies vary widely. Most policies provide for a per diem benefit payable for a limited duration, such as up to 3 or 5 years. Ideally, the policy contains a broad list of Activities of Daily Living (ADL’s) with coverage triggered by the insured’s inability to perform a given number of ADL’s, and a premium waiver in the event that benefits become payable.
While the LTC insurance company was happy to sell you the policy and collect its premiums, it may take a different approach when presented with a claim. We expect LTC claims to become even more difficult, as insurers are faced with the combination of increasing health care costs and plummeting investments.
